Italian Supreme Court validates pre-crisis marital agreements
The Italian Supreme Court (Corte di Cassazione) has issued a landmark ruling recognizing the validity of agreements between spouses regarding future crises. This decision, specifically via ordinance 20415 of July 21, 2025, allows couples to use atypical contracts to regulate patrimonial matters and assets in the event of a separation.
While this moves Italy closer to the Anglo-Saxon model of marital agreements, the ruling imposes strict limitations. These agreements cannot override fundamental legal protections, particularly regarding child welfare, maintenance payments, and divorce alimony. The court emphasized that while such contracts are legitimate expressions of negotiating autonomy, they must respect non-negotiable legal standards.
There is a growing interest in these agreements among Italian couples, particularly those seeking to protect real estate, businesses, or assets acquired prior to marriage.
