Italy administrative law updates regarding public contracts
Recent administrative jurisprudence in Italy has clarified several aspects of public contract law and public works. Key rulings from the Council of State and the Court of Auditors address the following:
Technical offers that exceed dimensional limits may be considered invalid if they create an undue competitive advantage that disrupts the principle of equal treatment among bidders. Additionally, the distinction between subcontracting and corporate cooperation must be determined by the substance of the relationship and the actual function performed by a third party, rather than the mere existence of a functional relationship.
Regarding environmental standards, contracting authorities are required to include specific Minimum Environmental Criteria (CAM) within the lex specialis, rather than providing generic references to ministerial decrees. Furthermore, declaring an intent to subcontract a portion exceeding permitted limits does not automatically result in exclusion if the subcontracting is optional, as such errors may be corrected through administrative remedy processes. Finally, maintaining a regular DURC (Documento Unico di Regolarità Contributiva) throughout the relevant period prevents disqualification from participating in tenders.
