Italy's Senate pushes bill to create a specialised Digital Court

The Italian Senate is considering a draft law, known as the Irto bill, to establish a specialised Digital Court. Drafted by attorney Antonino Polimeni and deposited by Senator Nicola Irto (PD), the proposal would create judicial sections dedicated to disputes over software, cloud services, data management, artificial‑intelligence systems and other digital components that now permeate every sector of the economy.

Proponents argue that judges need technical expertise to assess issues such as AI reliability, error margins and design defects. The bill calls for magistrates to receive training at the Superior School of the Magistracy, ensuring they can evaluate complex technological matters without relying solely on external consultants. Marianna Chillau, Chief Revenue Officer of b2x and president of 4eCom, stressed that “the digital sector is now an infrastructure for all enterprises, and the justice system must keep pace.”

If enacted, the Digital Court would aim to deliver more uniform and competent rulings in an era where digital services are integral to manufacturing, distribution, agriculture and finance.
