Italy: Cadastral reclassification for historic properties

Owners of historic or period properties in Italy may request a cadastral reclassification to reduce tax burdens when the building's prestige has diminished. This typically occurs when outdated systems or poor energy efficiency result in a loss of modern livability and market value that previously justified a luxury classification.

Legal arguments for such requests are rooted in Article 53 of the Italian Constitution, which mandates proportionality between tax burdens and actual wealth. For a property to maintain a luxury status, such as the A/1 category, it must possess characteristics that are clearly superior to the average residence. If these features are no longer present due to technological obsolescence or lack of modern comforts, the current tax assessment may be considered illegitimate.

Key factors influencing these decisions include energy efficiency classes and the presence of modern amenities. While large surface areas do not automatically guarantee a luxury classification, the loss of high-end functional characteristics can serve as grounds for downgrading the property's fiscal category.
