Italy condominium laws and legislative reforms

Italian condominium regulations and the processes for dividing large residential complexes into autonomous parts are subject to specific legal requirements and ongoing legislative updates. Under current law, a condominium can be dissolved and divided into independent entities only if the resulting portions possess structural and functional autonomy, allowing for physical vertical separation.

The procedure for such a division requires specific assembly majorities and often involves the intervention of a notary to formalize the transformation of property rights. Even after separation, certain assets may remain shared among owners.

Legislative frameworks, including Law 220/2012 and subsequent decrees, have modernized the Civil Code regarding administrator requirements, common areas, assembly quorums, and financial management. Furthermore, the Senate Justice Commission is currently reviewing new provisions (DDL 1816) aimed at regulating condominium discipline in buildings.
