Italy condominium management and heating exemption guidelines

Guidelines have been outlined regarding the management of condominium expenses and technical exemptions for heating systems in Italy.

For heating systems, technical reports are required to seek exemptions from installing thermostatic valves. These reports must be drafted and signed by a qualified technician, identifying the specific property, heating system type, and the number of radiators. Valid reasons for exemption include physical accessibility issues, risk of damage to structures or furniture, incompatibility with specific radiator types, or historical and architectural constraints.

Regarding general condominium management, the Italian Civil Code dictates that expenses for the maintenance and use of common areas are distributed among owners based on the proportional value of their property. While millesimal tables are the standard, exceptions can occur due to differing uses of common assets or specific agreements between neighbors. The law also specifies that the assembly cannot vote to charge regular owners for the debts of delinquent residents.
