Italy Council of State rules on university enrollment for disabled students

The Italian Council of State has issued a landmark ruling regarding the rights of university students with severe disabilities. The decision establishes that students with documented medical or caregiving needs who pass admission tests for limited-enrollment courses have the right to transfer to a university closer to their residence, even if it exceeds the established enrollment numbers.

Previously, existing regulations often forced students to choose between abandoning their studies or attending universities without adequate local support. This ruling sets a national judicial precedent, ensuring that enrollment caps do not act as an absolute barrier when health and assistance requirements make attending a distant institution incompatible with the student's condition.
