Italy courts and municipalities suspend demolition orders for illegal construction
The Administrative Regional Court of Campania (TAR) annulled the municipal rejection of a "Salva Casa" regularisation request and suspended the execution of a demolition order and a €20,000 fine related to a small bathroom extension and two façade openings. The court instructed the municipality to re‑examine the case under article 36‑bis of the building code.
Separately, the municipality of Ischia issued an order to demolish unauthorised works on state maritime demesne in the “braccio a mare” area. The order targets extensions, new volumes and covered spaces that exceed the original authorisation and cannot be regularised. The owner must remove the works and restore the site within 90 days, after which the municipality may act and charge the costs.
