Italy updates disability regulations and INPS procedures
Italy is implementing several updates and clarifications regarding disability rights, social security benefits, and workplace inclusion.
INPS has introduced new digital procedures for disability applications. Through the integration of the Docsan system and the Intermediary Platform, citizens can now use a single digital mandate to allow patronati to submit health documentation, eliminating the need for additional paper delegations.
Regarding benefits, the Corte di Cassazione has clarified that recognition of severe disability under Law 104/1992 does not automatically grant the 'indennità di accompagnamento' (attendance allowance). This benefit requires specific medical criteria, such as 100% invalidity and the inability to walk without assistance, and must be explicitly requested in court. Additionally, INPS has specified that while multiple family members may share the three monthly paid leave days provided by Law 104/1992, the total limit remains three days per month. Any usage exceeding this collective limit will be considered undue and subject to recovery.
On the corporate side, recent discussions highlight a shift toward disability reform that emphasizes creating 'enabling environments' in the workplace. This approach encourages companies to adapt work contexts to the individual's needs rather than requiring the individual to adapt solely to the existing environment.
