Italy implements tax law reforms and lighter sanctions

Recent reforms in Italian tax law have introduced lighter sanctions for certain offenses. For instance, penalties for inaccurate declarations have shifted from a range of 90% to 180% of the evaded tax to a fixed rate of 70%. However, these new measures apply to facts committed from September 1, 2024, to protect tax revenue.

The relationship between national legislation and European Union law remains a complex area, particularly regarding direct taxes like VAT, where Italian regulations are subordinate to EU norms. While the principle of applying the most lenient penalty is a standard of justice, the interplay between state and community law often leads to legal disputes and litigation.
