Italy introduces 15-year limit on notary liability claims

New Italian legislation has introduced strict time limits regarding the professional liability of notaries. Under Law 145/2026, which converted Decree-Law 100/2026, a definitive expiration period has been established.

Citizens are no longer permitted to initiate compensation claims once fifteen years have passed from the date of the public deed or the authentication of a signature. This rule acts as an absolute forfeiture period, meaning no exceptions are permitted. Additionally, the law maintains a ten-year statute of limitations, which begins to run from the moment the damage becomes known to the party who requested the service. These regulations apply to all notary services performed after June 12, 2026.
