Italy introduces 5% tolerance threshold for POS and receipt discrepancies

The Italian government has introduced a 5% tolerance threshold through the Omnibus decree to protect merchants from sanctions resulting from minor discrepancies between electronic POS payments and fiscal receipts.

This measure aims to prevent administrative penalties and accessory sanctions, such as the temporary suspension of business licenses, caused by unintentional errors. Common scenarios leading to such mismatches include high-traffic periods during peak hours or complex group payments where customers use various methods.

Under current regulations, repeated discrepancies can lead to significant consequences, including fines of 100 euros per infraction (up to 1,000 euros per quarter) and the potential suspension of business activities for three to six months if four violations occur within five years and the disputed amount exceeds 50,000 euros. The new threshold provides a safeguard against these penalties for minor, non-fraudulent deviations.
