Italy: Legal obligations for condominium water infiltration repairs

Under Italian law, property owners and condominium associations face strict obligations regarding water infiltration and ceiling damage caused by issues in overlying roof terraces. When water enters an apartment due to problems with a common roof area, the law mandates immediate intervention.

Repair costs are distributed between the exclusive owners of the terrace and the entire condominium based on specific mathematical criteria. However, legal complications often arise if terrace owners have made unauthorized modifications. To address imminent dangers, citizens can utilize the ‘denuncia di danno temuto’ (report of feared damage) under the Civil and Code of Civil Procedure. This legal tool allows a judge to order urgent repairs to prevent property destruction and protect the health of residents.
