Italy: Legal requirements for pergola installations

Legal guidelines in Italy clarify the requirements for installing pergolas (pergotende) under the 'edilizia libera' (free building) regime, which allows for certain external structures without formal municipal permits.

To qualify for this regime, the structure must not alter the building's volume. According to administrative jurisprudence, including rulings from the Consiglio di Stato, the installation must be a lightweight structure with no permanent stability. The primary function must be solar protection, and the components, such as support poles, should serve only to tension the fabric rather than acting as a permanent construction.
