Italy legal rulings clarify family property and tax rights

Recent legal clarifications in Italy address property rights and tax exemptions within family structures following death or separation.

Regarding inheritance, judicial rulings establish that a surviving spouse’s right of habitation prevails over the claims of adult, independent children. While children may inherit a share of the family home, the surviving parent has legal tools to claim exclusive use of the property, especially if cohabitation becomes difficult or if the children do not contribute to household expenses. This ensures the continuity of the surviving spouse’s lifestyle.

In matters of taxation, the Supreme Court of Cassation has clarified that the IMU (municipal property tax) exemption for a primary residence cannot be denied solely because spouses live in different locations. The exemption depends on where the owner actually resides and habitually lives, rather than requiring the entire family unit to cohabit. This ruling protects taxpayers who maintain separate residences for reasons such as work or personal circumstances.
