Tribunale di Marsala rules relatives are not automatically liable for deceased's debts

The Court of Marsala has issued a ruling (sentence no. 405, dated June 29, 2026) clarifying the legal boundaries regarding inheritance and the debts of the deceased. The court established that being called to an inheritance does not automatically transfer the deceased person's liabilities to their relatives.

To assume the role of an heir and the subsequent economic burdens, a person must demonstrate a real and concrete acceptance of the inheritance. Without this formal act, debts remain frozen and unenforceable against the relatives. The ruling emphasizes that creditors, such as banks or tax authorities, bear the absolute burden of proof under Article 2697 of the Civil Code to demonstrate that a relative has explicitly or tacitly accepted the status of heir. Mere family ties or the existence of a will are insufficient to trigger automatic liability.
