Italy: Legal split over renovation limits for regularized buildings

Italian jurisprudence is currently divided regarding the types of renovation work permitted on buildings that have been regularized through building amnesties (condoni edilizi). While an amnesty guarantees the legal survival of a structure, it does not grant the same level of transformation freedom as a building constructed in full compliance with original laws.

The Constitutional Court has established strict boundaries, ruling that such properties are subject to a special legal status. According to the Court, owners are limited to conservative or maintenance-based works, such as replacing roofs, consolidating foundations, or updating systems, rather than major structural transformations.

In contrast, administrative courts have shown greater flexibility in interpreting renovation rights. This legal divergence creates uncertainty for property owners attempting to renovate or modify the silhouette of regularized buildings, as the distinction between permitted maintenance and prohibited new construction remains a point of contention.
