Italy prepares for election of lay members to the CSM
The Italian Parliament is preparing to elect ten lay members to the High Council of the Judiciary (Consiglio Superiore della Magistratura, CSM). This process occurs alongside the voting by magistrates to renew the judicial component of the council.
Lay members are elected by Parliament in a joint session and must be either full professors of legal subjects or lawyers with at least fifteen years of professional experience. The upcoming elections are viewed as a critical moment for the CSM, determining whether it will function as a constitutional guarantee organ or as a space for political distribution.
While the law does not prohibit former politicians from serving as lay members, discussions emphasize that these members should represent legal culture external to the judiciary rather than acting as political emissaries. The role requires maintaining independence from the political parties that nominate them to effectively balance the council's functions.
