Italy: Regulations for transitional rental contracts

Transitional rental contracts in Italy serve as a specific housing solution for individuals with documented temporary needs, such as students, professionals in training, or families undergoing home renovations. Unlike standard long-term leases, these agreements are designed for limited durations and must be justified by specific circumstances like work, study, or medical care.

Under Italian law, specifically Law 431/1998 and the ministerial decree of January 16, 2017, these contracts cannot exceed a maximum duration of 18 months. To remain valid, the temporary nature of the housing need must be clearly documented and proven. Failure to adhere to these formal requirements carries the legal risk of the contract being reclassified as a standard residential lease with a duration of 4+4 years.
