Italy rental regulations: mediation requirements and agreed rent benefits

In Italy, residential rental agreements are subject to specific legal frameworks regarding mediation and rent calculation. For landlords facing non-payment, mediation is a mandatory procedural step under Legislative Decree 28/2010. Failure to initiate this mediation process before seeking a judicial decision can result in the judge being unable to rule on the merits of the dispute.

Additionally, the 'canone concordato' (agreed rent) system offers an alternative to free-market pricing. Governed by Law 431/1998, this model requires rent to fall within specific ranges established by local territorial agreements between municipalities and associations. While limiting rent freedom, this system provides significant tax benefits, such as a 10% 'cedolare secca' and reduced IMU property taxes. Data indicates these subsidized contracts are growing, now covering over 31 percent of residential leases.
