Italy tax agency audits tennis players over prize money VAT

The Italian Revenue Agency (Agenzia delle Entrate) has launched tax audits targeting professional tennis players residing in Italy. The investigation focuses on whether prize money earned in ATP and WTA tournaments should be subject to Value Added Tax (VAT) and if proper invoicing has been conducted.

A central legal debate concerns whether prize money constitutes payment for a service or a reward for a sporting result. Tax experts argue that because tournament winnings are not guaranteed and depend entirely on uncertain sporting outcomes, they lack the direct link between service and compensation required for VAT application. This position is supported by precedents from the Court of Justice of the European Union and the Italian Supreme Court, which have previously ruled that payments contingent on uncertain future events do not constitute taxable services.

While prize money is contested, other forms of income such as sponsorships, promotional activities, and guaranteed appearance fees remain clearly subject to VAT. The situation is further complicated by the legal distinction between tennis's status as an amateur sport under certain local Italian regulations and the professional status held by players within international associations.
