Italy tax rulings and 730 return deadlines

The Milan Tax Court has upheld the legality of the tax authorities issuing payment notices without prior warning in cases involving simple tax liquidations. According to the court's ruling, the Agenzia delle Entrate may proceed directly to collection if the tax claim is based on mathematical calculations of amounts already declared by taxpayers, provided no substantial uncertainties exist regarding the data.

Under current regulations, a formal invitation to regularize a position is only mandatory when there are relevant doubts. If the tax office merely identifies a missing payment based on existing declarations, the process can be automated. Taxpayers may still be eligible for a one-third reduction in penalties if they pay the recalculated debt within 60 days of receipt.

Separately, taxpayers in Italy are approaching the deadline of October 26 to submit an integrative 730 form. This allows individuals to correct errors or include forgotten deductible expenses, such as medical costs or school fees, to obtain refunds. However, errors that result in underpayment to the state cannot be corrected via the 730 model and require a different corrective filing process.
