Italy unemployment benefits: NASpI and termination rules

In Italy, understanding the distinction between resignation and consensual termination is critical for workers seeking unemployment benefits. A consensual termination, which is a bilateral agreement between employer and employee, does not automatically grant access to NASpI. Under current law, such an agreement is treated as a voluntary cessation of employment, similar to a resignation.

To qualify for NASpI through a consensual termination, the agreement must be reached through specific conciliation procedures, such as those under Article 7 of Law 604/1966 before the Territorial Labor Inspectorate. Other qualifying circumstances include dismissal for just cause, protected maternity or paternity leave, or employer-mandated transfers to distant locations.

Applying for unemployment involves two distinct processes: obtaining official status as an unemployed person through a declaration of immediate availability (DID) at an employment center, and requesting economic support from INPS. While NASpI is the primary benefit for employees, other categories such as research fellows and PhD students may access Dis-Coll benefits, provided they meet specific regulatory requirements.
