INPS updates sick leave rules for retroactive certification

INPS has introduced new regulations regarding the commencement of sick leave benefits, effective from September 4, 2026. Under Circular No. 92, medical certificates can now be backdated by a maximum of one day to cover the day prior to the actual medical visit. Previously, this retroactive coverage was primarily reserved for home visits; the new rule extends this possibility to outpatient visits as well.

This change aims to address organizational and healthcare challenges, such as limited access to primary care physicians and the practice of scheduled outpatient appointments. However, several conditions apply: the backdating cannot exceed one day, and it does not apply if the preceding day falls on a Saturday, Sunday, or a weekday holiday, during which medical continuity services (guardia medica) are required. This update applies to continuation and relapse certificates but does not alter the worker's obligation to notify their employer of their absence.

Additionally, other social security and welfare updates in Italy include the release of an updated 'Pensami' digital simulator for pension scenarios, and new protections for caregivers and employees with serious illnesses, including additional paid leave and improved access to mortgage guarantees.
