Italy waste tax TARI faces criticism over rising costs and recycling paradox

The association Fare Verde has highlighted a paradox regarding the TARI waste tax in the province of Frosinone, noting that waste management tariffs often increase even as recycling rates improve. This trend appears to contradict the European Union principle of ‘polluter pays’ established in Article 191 of the Treaty on the Functioning of the European Union.

The issue stems from the fact that TARI is designed to cover 100% of municipal waste service costs rather than measuring actual waste production. As municipalities transition to door-to-door collection to increase recycling, costs for personnel, vehicles, and equipment rise, driving up the tax burden for citizens regardless of their recycling habits.

Additionally, legal complexities exist regarding the application of the tax to specific properties. Under Law 147/2013, the tax is based on the possession of areas susceptible to producing urban waste. However, certain areas, such as non-operational outdoor spaces or accessory areas like uncovered parking spots, may be exempt from the tax calculation under specific conditions.
