Italy legal updates: rulings on caregiver rights and Ilaria Salis

Several legal rulings in Italy have addressed diverse issues regarding labor rights, professional ethics, and criminal procedure.

A court in Rimini upheld the rights of a caregiver mother to work morning shifts to assist her disabled child, rejecting an employer's attempt to transfer her to a distant location. Separately, the Supreme Court of Cassation confirmed a sanction against a lawyer for failing to deliver case documents to a client, emphasizing that legal files belong to the client.

In a high-profile case, the Milan Court of Appeal annulled a first-instance sentence against MEP Ilaria Salis. The ruling found that the legal notification process was formally deficient, as the bailiff failed to conduct adequate searches for her at her reported residence.

In criminal matters, the Court of Cassation rejected appeals from the Cosenza Prosecutor regarding the unsealing of beach establishments in Santa Maria del Cedro. Additionally, the court dismissed a request for special surveillance against Rocco Ascone, citing a lack of current social danger. Finally, the court upheld acquittals in the 'nuove leve' 'ndrangheta trial in Vibo Valentia, following procedural disputes regarding electronic document filing.
