Constitutional Court strikes down Emilia-Romagna short-term rental rules

The Italian Constitutional Court has struck down two key provisions of an Emilia-Romagna regional law aimed at regulating short-term tourist rentals. While the Court recognized the authority of regions and municipalities to intervene in matters of urban planning to combat overtourism, it ruled that specific articles (4 and 5) were unconstitutional due to being disproportionate and creating unjustified disparities between short-term rental managers and other hospitality providers.

Regional officials have stated they will review the ruling to make necessary adjustments while maintaining their commitment to balancing tourism development with residential rights.

In other regional developments, the Municipality of Sesto ed Uniti is appealing to the Council of State regarding a biogas-to-biomethane conversion project in Casanova del Morbasco, facing opposition from local committees over environmental and health concerns. Additionally, the Council of State has suspended eviction notices in Bacoli, ruling that concessionaires cannot be removed without a proper plan in place. In Reggio Calabria, the TAR has reinstated a Carabinieri trainee after finding that her expulsion was based on incorrectly recorded academic failures.
