Italy's Council of Ministers Requests Court Review of Ten Magistrate Promotions

On 4 June 2026 the Italian Council of Ministers asked the Court of Auditors for clarification on a decision to promote ten accounting magistrates to Section President positions, despite only nine vacancies being available. While the promotions are formally lawful, the Council highlighted concerns about their suitability under the new Law Reform No. 1/2026, which reduces managerial posts in the Court.

The request follows criticism that several of the promoted magistrates, including Carmela Mirabella and Luigi Caso, were involved in the decision‑making process for the Stretto Bridge project. Sub‑Secretary Alfredo Mantovano urged a halt to the appointments, citing conflicts with the Foti law that restructures the Court’s powers. Other magistrates mentioned—Adriana Laporta, Elena Tomassini, Marialuisa Romano and Adelina Corsetti—had previously opposed career‑separation reforms.

The Council’s move seeks to ensure the promotions comply with the updated legal framework and address potential conflicts of interest linked to the controversial infrastructure project.
