Italy's Court of Cassation limits powers of resigning condominium administrators
The Italian Court of Cassation has issued rulings clarifying the limitations of authority for condominium administrators who have resigned. According to ordinances 21883 and 22005 of 2026, a resigning administrator immediately loses all ordinary management and legal representation powers.
Specifically, the court established a ban on granting powers of attorney for litigation and the convening of assembly meetings, except in cases of extreme urgency. The ruling emphasizes that under Article 1129, paragraph 8, of the Civil Code, a professional whose mandate has ended—whether through expiration, judicial revocation, or voluntary resignation—may only perform urgent and unavoidable acts to protect common interests. Any other ordinary functions cease instantly, prohibiting autonomous management without a valid assembly mandate.
