Italy's Court of Cassation rules on asset disclosure obligations

The Italian Court of Cassation has rejected an appeal by Severino Testa, ruling that registering vehicle sales in the Public Automobile Register (PRA) does not fulfill legal obligations regarding asset disclosure under anti-prevention regulations.

The court clarified that disclosure requirements apply not only to increases in total wealth but also to changes in the composition of assets involving values exceeding 10,329.14 euros. The ruling emphasized that the mere public availability of transaction data does not guarantee that law enforcement agencies have actual knowledge of the changes.

While the court noted that responsibility for omissions requires proof of intent and the capacity to endanger protected interests, it upheld the previous decision regarding the defendant's failure to report asset variations between 2014 and 2016.
