Italy's CSM approves new psychological tests for magistrates

The High Council of the Judiciary (CSM) has approved a resolution establishing new psycho-aptitude tests for future magistrates, following a 2024 reform. The evaluation process is designed to identify conditions that would render a candidate unfit for judicial functions, specifically for the roles of judge and public prosecutor.

The assessment will focus on five key areas: cognitive (analytical reasoning and problem-solving), emotional (stress management and self-control), relational (empathy and communication), ethical-value (equity and autonomy of judgment), and organizational (time management and work organization). The procedure is not intended to be a clinical or pathological diagnosis, but rather to ensure the absence of elements incompatible with judicial duties.

The evaluation will consist of three stages: a written test, an oral interview conducted by the commission president with the assistance of a professional psychologist, and a final evaluative synthesis by the examining commission.

The National Association of Magistrates (ANM) has protested the decision, arguing that such a tool could be used to influence the judiciary starting from the recruitment phase. The CSM resolution passed with six abstentions.
