Sardinia Court rules on Solinas and Satta administrative liability

The Corte dei Conti in Sardinia has issued two contrasting rulings regarding administrative appointments. Former Governor Christian Solinas and former assessor Valeria Satta were acquitted in a case involving the appointment of a director general, as the court found the candidate possessed sufficient professional qualifications.

However, Solinas and Satta were ordered to jointly compensate the Sardinia Region for 623,893 euros following the appointment of Antonio Belloi to the Civil Protection department. The court ruled that Belloi lacked the required legal qualifications and noted that the officials proceeded despite an unfavorable internal assessment, a decision characterized by the judges as intentional and harmful to institutional prerogatives.

In broader legal developments, the Italian judiciary continues to address complex issues of liability and proof. Recent rulings have clarified the rights of shareholders to report administrators for misappropriating funds and established that administrators remain responsible for document-related bankruptcy even when using simplified accounting or professional services. Additionally, the Court of Cassation ruled that payments made to INPS by a client to replace a defaulting contractor are ineffective if made after the contractor's bankruptcy declaration, to protect the equality of creditors.
