India ITAT issues multiple rulings on diverse tax disputes

The Income Tax Appellate Tribunal (ITAT) has issued several rulings across various jurisdictions in India, addressing diverse tax disputes involving individual taxpayers, charitable trusts, and property transactions.

In one case, the Delhi ITAT accepted a source of ₹23 lakh deposited into a wife’s account, ruling that the funds originated from her husband’s sale of trees and mangoes. In another ruling, the ITAT upheld a tax rebate under Section 87A for short-term capital gains under the new tax regime.

The Jaipur ITAT handled multiple cases, including restoring a ₹70.42 lakh exemption claim for a charitable trust after its registration rejection was set aside. The tribunal also deleted a ₹1.15 lakh TDS demand, ruling that an offline Form 26A was sufficient evidence that tax had been paid. Additionally, the Jaipur bench deleted a ₹4 lakh addition against an individual, stating that a code name and contact number in a third party’s phone were insufficient evidence of unexplained transactions.
