İzmir court protects family unity in teacher relocation ruling
The İzmir 7th Administrative Court has ruled in favor of a guidance teacher represented by the Eğitim ve Bilim Gücü Dayanışma Sendikası (Eğitim Gücü Sen), overturning a mandatory relocation based on 'norm cadre' surplus.
The teacher, originally based in Karabağlar, was reassigned to Menderes due to staffing regulations. However, the teacher's spouse is a First Lieutenant in the Turkish Armed Forces subject to mandatory relocation, stationed in Narlıdere.
The court unanimously decided to annul the reassignment, emphasizing that the protection of family unity must be prioritized for spouses of public officials subject to mandatory relocation, such as military personnel, police officers, judges, and prosecutors. The ruling noted that institutions cannot use service points or staff shortages as justifications to prevent appointments that aim to preserve family unity under existing regulations.
