James Comey legal team fights DOJ attempt to charge former FBI director

Former FBI Director James Comey appeared in a Washington, D.C. federal court on Friday as his legal team sought to dismiss a criminal case brought by the Justice Department. Prosecutors allege that Comey violated the Espionage Act by transmitting national defense information to a reporter in connection with a 2016 New York Times article.

In an uncommon legal maneuver, federal prosecutors filed a criminal information rather than a grand jury indictment. The Justice Department stated this step was taken to preserve the case before a 10-year statute of limitations expires. However, Comey’s attorneys argue the filing is legally invalid and should be dismissed as time-barred.

U.S. District Judge Trevor McFadden heard arguments regarding whether the government improperly used the criminal information to extend the statute of limitations. Prosecutors claimed they have uncovered new evidence that could extend the window for charges through April 2017. The judge did not immediately rule on the request to dismiss the case.
