Jammu and Kashmir High Court mandates AIBE for advocates
The Jammu and Kashmir High Court has directed the formal implementation of the All India Bar Examination (AIBE) requirements for advocates enrolled in the Union Territories of Jammu and Kashmir and Ladakh.
Under the new directive, law graduates enrolled as advocates who graduated in the 2009–10 academic year or later must qualify for the AIBE if they have not already done so. Advocates enrolled after July 1, 2010, who have already passed the examination are required to submit copies of their Certificates of Practice (COP), issued by the Bar Council of India, to the High Court Registry within one month.
Furthermore, fresh law graduates and those enrolled provisionally will only receive an absolute certificate of enrollment after passing the AIBE and providing their Certificate of Practice within a two-year period. This decision follows recommendations from the High Court’s Rules Committee and aligns with the Bar Council of India Rules regarding the right to practice law under the Advocates Act, 1961.
