Japan gift tax implications for 5 million yen transfers

In Japan, gifting a lump sum of 5 million yen from a parent to an adult child may result in a gift tax of approximately 485,000 yen. This calculation is based on the 1.1 million yen basic deduction, leaving a taxable amount of 3.9 million yen, which is subject to a 15% tax rate with a 100,000 yen deduction.

While gifting within the 1.1 million yen annual basic deduction is generally tax-free, taxpayers should be cautious of 'periodic gift contracts.' If a person commits to giving a set amount every year for a fixed period (e.g., 1 million yen annually for five years), the tax authorities may view this as a single gift of the total amount due at the time the contract is made.

To mitigate tax risks, experts suggest creating a gift contract each year to demonstrate separate transactions. Additionally, funds provided directly for necessary living expenses or educational costs for dependents are often exempt from gift tax, even if they exceed the basic deduction, provided they are used for those specific purposes as needed.
