Japan: Legal procedures for managing unpaid cemetery fees and abandoned graves

In Japan, the management of graves with unpaid fees is governed by specific legal procedures and cemetery regulations. When management fees are not paid, cemetery operators cannot unilaterally terminate contracts without reasonable cause. Standard guidelines suggest that after a period of non-payment, operators must issue a formal demand for payment before proceeding with contract termination.

For graves deemed to have no living relatives (unrelated graves), the process of relocating remains requires a formal public notice via the official government gazette (Kanpo) and a physical notice posted at the site for one year. This period allows relatives to come forward. Following this, permission from the municipal mayor is required under the Cemetery and Burial Act to perform a reburial (kaiso).

Recent administrative communications from the Ministry of Health, Labour and Welfare clarify that while the relocation of remains is a legal process, it does not inherently resolve private property rights regarding the gravestones themselves. The handling of remaining stones depends on whether the cemetery is public or private, following local ordinances or individual contracts respectively.
