Japan residential land tax reduction depends on heir status

The special provision for small-scale residential land in Japan allows for an up to 80% reduction in the taxable value of land used for residential purposes, up to 330 square meters. However, eligibility for this tax reduction depends heavily on the relationship between the deceased and the heir.

Spouses are generally exempt from specific residency requirements to qualify. For cohabiting relatives, the requirement is that they must continue to live in and own the property until the inheritance tax filing deadline.

Non-cohabiting relatives, often referred to as ‘homeless children’ (ienaki-ko), must meet strict criteria: the deceased must not have had a spouse, no other relative lived in the house immediately prior to death, and the heir must not have owned or resided in another home in Japan for the three years preceding the inheritance.

In cases where the deceased resided in a nursing home at the time of death, the previous residence may still qualify for the reduction if certain conditions are met. Because requirements vary significantly based on the heir's status, consultation with tax professionals is recommended.
