Jay Clayton’s DNI Confirmation Hearing Highlights Election Denial and Journalist Subpoenas

President Donald Trump nominated U.S. Attorney Jay Clayton to serve as Director of National Intelligence. During his Senate Intelligence Committee hearing on July 15, 2026, Clayton repeatedly declined to state that Joe Biden won the 2020 presidential election, saying only that the result was “certified.” Democrats, including Senators Jon Ossoff, Mark Warner and Mark Kelly, pressed him repeatedly, warning that refusal to acknowledge the election outcome could signal willingness to politicize intelligence.

Lawmakers also questioned Clayton about his recent subpoenas of New York Times journalists in his role as U.S. attorney for the Southern District of New York, citing concerns for the First Amendment. Additional topics included the FBI raid on a Georgia election office that involved former DNI Tulsi Gabbard and the temporary leadership of acting DNI Bill Pulte. The hearing preceded a scheduled presidential address on declassified intelligence related to election security. The Senate Intelligence Committee is expected to vote on Clayton’s nomination next week.
