Jean Bouveri Hospital governance faces legal scrutiny

The Collectif des Usagers des hôpitaux (CODEF) has raised legal questions regarding a proposal by the Regional Health Agency to grant the Mayor of Saint-Vallier an elective vote on the supervisory board of Jean Bouveri Hospital.

According to the French Public Health Code, the supervisory board of a communal public health establishment must consist of nine members divided into three equal colleges of three. These colleges represent local authorities, medical and non-medical staff, and qualified personalities, including user representatives.

CODEF notes that the local authority college is legally restricted to three specific seats: the Mayor of the host commune, a representative of the intercommunal cooperation public establishment, and the President of the Departmental Council. The group argues that adding the Mayor of Saint-Vallier as a fourth member would violate the principle of equal representation across colleges unless the entire board structure is modified.
