Jens Spahn mask dispute moves to higher court

A Hamburg-based textile trader, Matthias Timm of Pure Fashion Agency, has filed an appeal regarding a dispute over approximately 500 million euros in unpaid Corona-related mask deliveries. The legal battle centers on emails sent in March 2020 by former German Health Minister Jens Spahn, which Timm argues constitute a legally binding purchase contract.

In July, the Bonn District Court ruled against the trader, stating that the emails were merely an expression of interest rather than a finalized contract. The court also determined that any potential legal claims were time-barred and denied the plaintiff's request to call Spahn as a witness.

The plaintiff's legal counsel, Dennis Geißler, contends that the lower court's ruling contained errors and asserts that a payment reminder issued in late 2023 prevented the statute of limitations from expiring. The case will now move to the Cologne Higher Regional Court for review.
