Jerry Schwartz loses court appeal for Rydges Newcastle carousel

Jerry Schwartz, owner of Rydges Newcastle, has lost a legal appeal to install a carousel on the grounds of the Rydges at Honeysuckle hotel. The NSW Land and Environment Court dismissed the appeal following concerns regarding the impact of proposed landscaping on three tuckeroo trees located on public land.

Acting Commissioner Clare Swan ruled that the development application (DA) was insufficient due to inconsistencies between the landscape, architectural, and arborist reports. While the court did not find that the carousel's visual or heritage impacts alone justified a refusal, the documentation failed to adequately address whether the works intended to screen the structure would damage the trees.

During the proceedings, council experts argued the carousel would be a “garish” and highly visible structure that was “not of its place.” The decision follows a failed attempt at court-ordered mediation between Dr. Schwartz and the City of Newcastle.
