Jet Set nightclub case: charges upgraded to homicide with eventual dolus

A judge in the Dominican Republic has upgraded the legal classification of the Jet Set nightclub tragedy from involuntary homicide to voluntary homicide with eventual dolus. The decision, made by Judge Franny González Castillo of the Fourth Criminal Chamber of the National District, follows the April 8, 2025, roof collapse that killed 236 people and injured over 180 others.

Judge González ruled that the defendants, Antonio and Maribel Espaillat, had full knowledge of the structural deterioration and had received serious, documented warnings regarding the risks. The court determined that the owners chose to keep the establishment operational despite the imminent danger, meaning the tragedy was preventable and not a simple unpredictable accident.

Due to the change in legal classification, the judicial process will restart from the beginning before a collegiate court. Under the previous Dominican Penal Code, this new classification exposes the defendants to prison sentences ranging from 3 to 20 years. While the decision has been welcomed by victims' families as a step toward justice, some legal experts have raised questions regarding the principle of legality and whether the ruling was influenced by public pressure.
