JPMorgan warns US crypto regulatory landscape faces political risk
JPMorgan analysts have warned that current progress in US cryptocurrency regulation could be reversed following the 2028 presidential election if comprehensive market-structure legislation is not passed. The warning, led by analyst Nikolaos Panigirtzoglou, suggests that the industry currently relies on a patchwork of regulatory actions from agencies like the SEC, CFTC, and OCC that remain vulnerable to shifts in the political landscape.
While the Clarity Act recently failed to advance in the Senate due to a lack of consensus on national security and ethics provisions, individual regulators continue to move forward. The CFTC is developing rules for leveraged crypto trading, and the OCC has finalized stablecoin regulations under the GENIUS Act, set to take effect in January 2027.
Despite legislative deadlocks in Congress, markets have shown resilience, with Bitcoin and Ethereum seeing significant gains recently. Historically, the S&P 500 has trended upward in the year following midterm elections, often as investor uncertainty regarding taxes and regulation diminishes once election results are finalized.
