Bannon was convicted in 2022 for defying a subpoena from the committee investigating the January 6 Capitol attack. Nichols ruled that prosecutors failed to provide an adequate legal explanation for the dismissal as required by local rules, though he noted the decision was “without prejudice,” allowing the government to refile with more detail.
