Judge dismisses Reflecting Pool vandalism case against David Hearn
D.C. Superior Court Judge Todd Edelman has permanently dismissed felony vandalism charges against former U.S. Olympian David Hearn with prejudice. The ruling prevents the government from re-charging Hearn for allegedly damaging the Lincoln Memorial Reflecting Pool.
The case originated from allegations that Hearn damaged the pool's lining. However, the Justice Department later sought to drop the charges without prejudice after evidence suggested a government contractor was responsible for the damage.
In his ruling, Judge Edelman cited the extraordinary risk of political interference. He noted that President Donald Trump had repeatedly criticized the decision to drop the charges and pressured subordinates, creating a risk of “meritless, politically motivated prosecution.” The judge stated that dismissing the case with prejudice was necessary to protect Hearn from “harassment” and the uncertainty of potential future prosecution driven by political pressure.
