Justice Edward Amoako Asante urges legal action against unlawful police detention
Supreme Court nominee Justice Edward Amoako Asante has stated that suspects detained by police beyond the constitutionally mandated 48-hour limit have the legal right to sue for redress. During his appearance before Parliament’s Appointments Committee on August 27, 2026, Asante questioned why such legal challenges are rarely pursued to enforce constitutional protections.
Asante argued that Ghana’s existing legal framework, specifically the Criminal and Other Offences (Procedure) Act (Act 30), is sufficient to hold authorities accountable. He suggested that the creation of a separate Bail Act is unnecessary because current laws already provide the necessary mechanisms.
He further emphasized that legal practitioners have a responsibility to take action on behalf of clients facing unlawful detention. Asante noted that successful litigation and court-ordered compensation could serve as a deterrent, ensuring law enforcement agencies adhere strictly to constitutional standards.
