Justice Elena Kagan criticizes Supreme Court majority

Supreme Court Justice Elena Kagan delivered a speech at Catholic University’s law school, where she criticized the court’s conservative majority for undermining democracy through various rulings.

Kagan argued that the court has been “blinded itself to the very deleterious effects of their rulings on how the political system works,” leading to increased political polarization. She specifically highlighted the impact of decisions that have weakened the 1965 Voting Rights Act, struck down campaign finance restrictions, and limited the ability of federal courts to intervene in extreme partisan gerrymandering.

Kagan noted that these rulings have encouraged a “race to the bottom” regarding partisan redistricting, where both major political parties redraw congressional maps to maximize their own seats. She expressed concern that these lopsided maps deny citizens their rights to voting equality and push political candidates toward extremes.
