Justice Longkumer emphasizes mediation in Nagaland training
The Nagaland State Legal Services Authority (NSLSA), operating under the Supreme Court of India’s Mediation and Conciliation Project Committee, held a one-day training program for referral judges in Kohima.
During the session, Gauhati High Court Judge Justice Yarenjungla Longkumer stated that mediation is an essential component of a modern and humane justice delivery system, rather than just an alternative to litigation. She noted that the success of mediation relies on the wisdom and commitment of referral judges in identifying suitable cases.
Justice Longkumer identified several areas suitable for mediation, including matrimonial disputes, commercial conflicts, landlord-tenant matters, and motor accident claims. However, she cautioned judges to use discretion when screening cases to ensure that power imbalances, coercion, or domestic violence do not undermine voluntary consent. She emphasized that the goal is fair and informed participation rather than securing settlements at any cost.
